Credit Rebuilder Program — Terms of Service

This agreement is between you (“Client”) and Evergreen Financial Counseling, a 501(c)(3) nonprofit organization (“Evergreen,” “we,” “us,” or “our”).

By enrolling in the Credit Rebuilder Program, you agree to the following terms:

1. Program Overview

The Credit Rebuilder Program is a voluntary credit education and credit-building service designed to support individuals recovering from financial hardship. It is not required by your bankruptcy attorney or the bankruptcy courts.

2. Services Provided

Upon enrollment, you will receive:

  • Credit Reporting to all three major credit bureaus (Equifax, TransUnion, Experian) via Consolidated Capital.
  • Platinum Credit Review after bankruptcy discharge to help identify potentially inaccurate or outdated items (Evergreen does not dispute legitimate or accurate credit items).
  • Free legal support related to the Fair Credit Reporting Act (FCRA).
  • Consumer protection guidance in relation to FCRA violations.
  • Access to the “7 Steps to a 720 Credit Score” video course, plus ongoing educational updates.
  • Priority access to monthly Q&A sessions for 24 months.
  • Involuntary Unemployment Benefit (IUB): If you lose your job through no fault of your own, your program will continue without interruption.

3. Payment Terms

  • Set-Up Fee: A one-time $99 setup fee, charged on your selected enrollment date.
  • Monthly Payment: $39 per month for up to 24 months.
  • You may select a payment date between the 1st and 14th of each month.
  • The first $39 payment will be charged within 60 days of your setup fee.
  • If no date is selected, payments will begin upon enrollment and recur on the 1st of each month.
  • A $25 fee may be charged for returned or failed payments.

4. Credit Reporting Details

  • Payments are reported under the name Consolidated Capital on your credit reports.
  • Reporting to all three credit bureaus begins after 90 days of on-time payments and includes retroactive data for the first three months.
  • Evergreen does not guarantee any specific outcome or score improvement as a result of this reporting.

5. Money-Back Guarantee

You may be eligible for a money-back guarantee only if you follow all program instructions exactly.

  • This program is not a loan, savings plan, or secured account.
  • You will not receive cash disbursements or refunds unless all guarantee criteria are met.
  • Payments are not held in escrow and will not be refunded upon program completion.

You may cancel this program at any time, for any reason, without penalty.

7. Enrollment and Processing Timeline

  • Enrollment may take up to 72 hours to process.
  • A “Welcome” email will be sent once your enrollment is active.
  • Please check your spam or junk folder and add [email protected] to your contacts.

8. Communication and Authorization

By enrolling, you:

  • Authorize Evergreen to contact you via email, phone, mail, or text message.
  • Authorize multiple payment attempts if a transaction fails.
  • Certify that you are an authorized user of the provided payment method.
  • Agree that electronic or phone communication may be used to confirm or modify your enrollment or account status.

9. Disclosures and Acknowledgements

  • Evergreen Financial Counseling is not a credit repair organization as defined under the Credit Repair Organizations Act (15 U.S.C. §§ 1679 et seq.).
  • We do not remove or dispute accurate, verifiable information from your credit report.
  • You have the right to dispute inaccurate information in your credit report at no cost by contacting credit bureaus directly.
  • You may obtain a free credit report annually from each of the three major credit bureaus at www.annualcreditreport.com.
  • You have the right to cancel this agreement within three business days of enrollment without penalty or obligation. To cancel, follow the instructions in Section 6.

 

Please note: If you are currently in an active bankruptcy, do not begin this program until your bankruptcy has been confirmed or discharged.

10. Acceptance of Terms

By checking the box and submitting your enrollment, you confirm that you have read, understood, and agree to be bound by these Terms of Service. Continued use of the Program constitutes acceptance of any future updates to these terms.
